Terms of Service
Effective 16 September 2026. Last updated 16 September 2026. These terms are an agreement between you and Spatial AI Labs Ltd. (“we”, “us”), a company registered in England and Wales at 71–75 Shelton Street, London WC2H 9JQ, United Kingdom, about the Heiki app. By using the app you accept them.
The short version
- Free never expires: three days with no limits, 14 days of Pro once you sign in with your Apple Account, then one estimate every three hours. Your journal is always yours to read.
- Pro removes the wait and unlocks everything. The 14 days are granted once per Apple Account, no card needed.
- Pro is a subscription or a pass, paid through Apple. Cancel any time in your Apple Account settings.
- An estimate is an estimate. It comes with a range because a photo cannot show everything.
- Heiki is not medical advice and not a medical device.
Who can use Heiki
You must be at least 16 years old, or older if the law where you live sets a higher age for agreeing to terms like these. We set that above the usual minimum for online services on purpose: calorie tracking is not a suitable tool for children. The App Store age rating matches.
What you get free
You can use Heiki without an account for the first three days, with no limits. Sign in with your Apple Account and you get 14 days of Pro, once. After that, estimates are limited to one every three hours and some features are reserved for Pro. The free tier never expires, and your journal stays readable, always.
What Pro is
The trial
Signing in with your Apple Account gives you 14 days of Pro at no cost. It is granted once per Apple Account, not once per install or device, and a new account made with the same Apple Account does not get another. No payment method is needed, nothing is charged, and nothing turns into a paid subscription when it ends. When the trial is over, you are back on the free tier.
Subscriptions
Pro is $9.99 a month or $49.99 a year (US prices; the price in your country is set by Apple and shown in the app before you buy). Payment is charged to your Apple Account when you confirm the purchase.
A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Apple charges the renewal within the last 24 hours of the period, at the price then in effect for your plan. Manage or cancel it in your Apple Account settings. Deleting the app does not cancel it.
Passes
A 3-month pass ($24.99) or a 6-month pass ($39.99) is a one-off purchase. It gives you Pro for that period and then ends. Passes do not renew, so there is nothing to cancel. Buying a pass while another is active does not add them together unless the app says so when you buy.
Price changes
Prices may change for future purchases and renewals. If a change affects a subscription you already have, Apple will tell you and, where required, ask you to agree; if you do not, it does not renew. A change never alters what you have already paid for.
Refunds
You buy through Apple, so Apple handles refunds. Ask at reportaproblem.apple.com. We cannot refund an App Store purchase ourselves, though we will help where we can. Rights the law gives you that cannot be waived are not affected.
Your right to cancel if you are a consumer in the UK or EU
Pro and each pass are digital content supplied without a physical medium. If you are a consumer in the United Kingdom, the European Economic Area or Switzerland, you normally have 14 days from the day of purchase to withdraw from the contract and receive a refund, with no reason given.
That right ends once supply has begun with your agreement. Pro is unlocked the moment you buy it, which is the point of buying it. By completing the purchase you ask us to begin supplying the digital content at once, and you acknowledge that you lose the right to withdraw once supply has started.
Where the right still applies, exercise it by writing to hello@spatialailabs.com with your Apple order reference, or through reportaproblem.apple.com. Apple is the seller of record, so Apple makes the refund. Your rights as a consumer — including under the Consumer Rights Act 2015 where digital content is not of satisfactory quality, not fit for purpose or not as described — are not affected by anything in these terms.
The estimate is an estimate
Heiki estimates the energy and macronutrients of a meal from a photo and from what you tell it. It shows a range and a confidence because the range is real: a photo cannot show oil soaked into food, sugar dissolved in a drink, or food hidden under other food. It can also be wrong in ways the range does not capture; an ingredient can be misread. Use your judgement.
Heiki is not a medical device and nothing in it is medical, nutritional or dietetic advice. It does not diagnose, treat or prevent any condition. Do not use it to manage a medical condition, and do not rely on it where an exact figure matters to your health — insulin dosing, an allergy, a metabolic condition. If you have or think you may have an eating disorder, please do not use calorie tracking software without medical support.
Your account
You can use the app without an account for a short while. Signing in with your Apple Account keeps your journal if you lose your phone and carries it between your devices. You are responsible for what happens through your account and for the accuracy of what you enter.
Your content
Your photos, notes and journal are yours. You give us only the licence we need to run the service for you: to store, process and send that content to produce and improve your estimate, including sending photos and your description to the model providers described in the Privacy Policy. We do not sell your content and we do not use it to train models, and neither do those providers under their terms with us. You are responsible for having the right to upload what you upload.
What you must not do
- Upload sexually explicit, pornographic or violent images. Heiki is for photos of food. Every photo is checked before it is estimated; an explicit upload is refused and recorded, and repeated explicit uploads permanently suspend the account, including the Apple Account it is linked to. We do not tell you which uploads counted, and there is no appeal. A suspended account keeps the journal already on its device.
- Upload photos of other people without their consent, or anything you do not have the right to upload.
- Upload anything unlawful, abusive, hateful or infringing.
- Use the app as a general image or text service, or for anything other than logging your own meals.
- Probe, scrape, overload or work around our services, limits or purchase checks, or automate the app.
- Resell or redistribute access to the app.
We may suspend or end access where these terms are broken, where the law requires it, or where continued use would put our own accounts with service providers at risk.
Availability and changes
We may change, pause or retire features. Estimates need a network connection and depend on third-party services; you can log a meal offline and estimate it later. We do not promise the app will always be available or free of errors.
Leaving
Stop using the app whenever you like. Delete your account in the app (Profile → Account → Delete account) or by writing to hello@spatialailabs.com; the Privacy Policy says what that removes. Deleting your account does not cancel a subscription. That is done in your Apple Account settings.
Apple’s licence
The app is distributed through the App Store under Apple’s Licensed Application End User License Agreement (the “Standard EULA”), which is part of these terms. Where the two add to each other, both apply; where they conflict, the Standard EULA governs the licence itself and these terms govern everything else. In short:
- You get a personal, non-transferable licence to use the app on Apple devices you own or control, including through Family Sharing where it is enabled.
- You may not copy the app (beyond what the App Store allows), reverse-engineer it, rent it, resell it or redistribute it.
- Apple is not responsible for the app or its content and has no obligation to maintain or support it. We do.
- Apple and its subsidiaries may enforce the Standard EULA against you.
- You confirm you are not in a country under a US Government embargo or designated as terrorist-supporting, and are not on any US Government restricted-party list.
Liability
To the fullest extent the law allows, the app is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and accuracy. We are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on an estimate. Where liability cannot be excluded, it is limited to what you paid for the app in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Governing law
These terms, and any dispute arising from them or from your use of the app, are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction.
If you are a consumer, this takes nothing away from you. You keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts. We will bring a claim against a consumer only in the courts of the country where they live. There is no arbitration clause and no class-action waiver in these terms.
Changes to these terms
We may update these terms. The date at the top changes, and material changes are announced in the app. Continuing to use the app after a change means you accept the updated terms.
